Unfortunately, there are no federal laws that protect gay and lesbian employees from sexual orientation discrimination in the workplace. However, such laws are being considered by Congress. Although there are no federal laws that protect gay and lesbian employees, several states, counties, and cities have passed laws geared toward protecting employees from sexual harassment discrimination.
Although there are currently no federal laws protecting against sexual orientation discrimination, there are current laws that prohibit employers from discrimination against employees because of gender stereotypes. For example, a lesbian employee that is fired for being too "butch" or a gay male employee who is fired for being a "sissy" may be protected under existing gender discrimination laws. Also, a gay male who is terminated because an employer believes that he may be HIV positive may be protected by the Americans with Disabilities Act.
